TERMS AND CONDITIONS
1. Organizer & Eligibility
1.1 Participation in the ‘Beryl’s Malaysia 100g Chocolate Bar Photo Contest (“the Contest”) constitutes
the participant’s full and unconditional agreement to and acceptance of these Terms & Conditions.
Beryl’s reserves the right to amend the Terms & Conditions at its sole discretion without prior
notice.
1.2 The Contest is open to all Malaysian citizens, permanent residents and overseas students (with
VISA), residing in Malaysia age 18 years old and above ONLY. Participants below the age of 18 years
old are required to seek parental or guardian consent before participating in the contest.
2. Duration
2.1 The Contest will run for 44 days starting from 18th September 2020 00:00:00 to 31st October 2020
11:59:59 following (UTC+08:00) Kuala Lumpur, Malaysia time zone (“Contest Period”).
2.2 Entries received outside the Contest Period are invalid and will not be entertained.
3. HOW TO PARTICIPATE
3.1 To participate in the Contest, participants must:
3.1.1 Step 1: Buy any Beryl’s 100g chocolate bar.
3.1.2 Step 2: Snap your most creative photo with it.
3.1.3 Step 3: Post, Hashtag #Beryls100gbar.
*Participant’s account needs to be set as public.
4. Submission
4.1 Entries are to be submitted via Facebook & Instagram ONLY. Participant are required to include
hashtag #Beryls100gBar & account needs to be set as public for tracking purposes.
4.2 Participant must follow our @Berylschocolate Facebook or Instagram profiles.
4.3 Each participant is eligible to submit more than one [1] photo throughout the Contest period.
Duplicated photo entries or photo submission without hashtag #Beryls100gBar will be forfeited.
4.4 Beryl’s management shall not be liable for any delay of photo submissions.
4.5 Entries submitted must NOT contain the following:
4.5.1 Nudity or sexual content.
4.5.2 Obscene language is not allowed.
4.5.3 Advertising for other products, services or websites
4.5.4 Copyrighted or trademarked material belonging to a third party unless legally authorized by
the third party to use such material.
4.5.5 Visible miring, dithering, graininess, blurriness, overexposure, compression artefacts or
other degradations to image clarity.
5. Winner’s Criteria for Judging the Photo Contest
5.1 Beryl’s will shortlist winners from the total entries based on the following criteria:
5.1.1 Creativity of the photo
5.1.2 Originality of the photo
5.1.3 Relevancy to theme
5.1.4 Creative captions is a plus
5.2 Announcement of winners will be made within a month (1st – 30th November 2020) after the
Contest Period has ended (31st October 2020).
6.1 Prizes & Number of Winners
6.1.1 | 1st Prize x 1 Winner | -RM2000 Cash -Chocolate Gifts (worth RM500) |
6.1.2 | 2nd Prize x 1 Winner | -RM1000 Cash -Chocolate Gifts (worth RM200) |
6.1.3 | 3rd Prize x 3 Winners | -RM500 Cash -Chocolate Gifts (worth RM100) |
6.1.4 | Consolation Prizes x 20 Winners | -Chocolate Gifts (worth RM100) |
6.2 Beryl’s Chocolate Management reserves the right to substitute any of the prizes with items of
equivalent value without prior notice and reason.
6.3 Prizes are not exchangeable, transferable or redeemable in any other form for whatever reason.
Contest Winners are solely responsible for the collection of their prize(s).
6.4 Winners need to show original receipt of purchase when claiming the prize.
6.5 Announcement of winners will be made on Beryl’s Malaysia Facebook, Instagram & Beryl’s Website
Contest Page.
6.6 Winners will be notified by direct or private message through Facebook or Instagram.
6.7 All Winners must respond to the Contest winning notification before 30th November 2020 & Beryl’s
management will not be responsible for any delayed response from any winners and reserves the
right to forfeit the prizes or assign the prizes to another Contest participant.
6.8 Winners are required to provide the following information accurately after receiving the winning
notification:
6.8.1 Original receipt of purchase
6.8.2 Photocopy of winner’s IC
6.8.3 Contact details
6.8.4 Email address
6.8.5 Shipping address
7. Prizes Redemption/ Delivery
7.2 Winners from Peninsular Malaysia:
7.2.1 For Winners from Klang Valley Malaysia - The Price [Cash / Chocolate Gifts] must be
collected personally within the given period (before 30th November 2020; Monday – Friday at
9am -5pm) at Beryl’s Headquarter Office, Seri Kembangan.
7.2.2 For Winners from Peninsular Malaysia residing outside of Klang Valley – Prize [Chocolate
Gifts] will be delivered to the winners, while Prize [Cash] will be issued to the winners in the
form of a cheque.
7.3 Winners from East Malaysia:
7.3.1 For Winners from East Malaysia – The Prize [Chocolate Gifts] must be collected personally
within the given period (Date TBC; Monday – Friday at 9am -5pm at Beryl’s Headquarter
Office, Seri Kembangan, while Prize [Cash] will be issued to the winners in the form of a
cheque.
7.3.2 Beryl’s Management will not deliver the Prize [Chocolate Gifts] to the Winners
from East Malaysia.
7.4 Winners that require a representative to claim their prize on their behalf must ensure that their
representative provide an authorization letter issued by the winner together with the original
receipt of purchase and a copy of the winner’s valid IC. Representatives will not be able to claim the
prizes if they failed to present the required documents.
7.5 If winners are unable to collect the prizes within the given time frame, all prizes will be forfeited.
Beryl’s management will make 3 attempts to notify winners.
7.A. Liability & Responsibility
7.A.1 All transportation, accommodation, internet charges, call charges, SMS, postage/courier,
personal costs and/or any other costs, fees and/or related expenses that are incurred to
participate in the Contest and prize redemption shall be the sole responsibility of the winner(s)
7.A.2 Participants shall assume full liability in the case of any mishap, injury, damage, claim or accidents
(including death) arising from their participation in the contest and/or redemption of the prizes.
7.A.3 Beryl’s Management shall not be liable to the Participants or any other party for any loss or
damage of whatsoever nature suffered by any participant as result of participation or non-
participation in the Contest or as a result of any act or omission on the part of Beryl’s Chocolate
Management.
7.A.4 Beryl’s Management shall not be held liable for any entry that is incomplete or illegible
due to problems such as computer malfunctions, lost Internet connections or transmission
problems.
9. Right of the Organizer
9.1 By participating in the Contest, the participants give consent and absolute right to the Beryl’s
Chocolate Management to use their names, photography and their prizes as materials for the
purposes of advertising, marketing and publicity without prior notice.
9.2 Participants shall not be entitled to claim ownership and/or any other forms of compensation for
the use of the materials by Beryl’s Chocolate Management.
9.3 Beryl’s Management reserves the right to modify, suspend and/or cancel the Contest at any time
without prior notice.
10. Personal Data Protection
10.1 Beryl’s Management will collect Contest participant’s personal data and information for
the following purposes:
10.1.1 To notify the participant if he/she won the Contest.
10.1.2 To verify the identity of participants for participation or prize collection.
10.2 Beryl’s Management will not share or sell your personal information with any other
organization. However, we may be under a duty to disclose your personal information in order to
comply with any legal obligation.
